Well another chief's election, another attempt by the incumbent autocrat's camp to squelch free speech. No Third Term for Michell Hicks' Facebook page had a photo removed after it was deemed that the photo violated its terms of service. The photo depicted a cross burning with a "re-elect Michell Hicks" sign in front.The photo completely and entirely falls in the protections of the First Amendment to the constitution and is further protected on tribal lands thanks to the Indian Civil Rights Act and a law passed by Tribal Council recognizing the Indian Civil Rights Act. Also what must be noted is the libel law's application to public officials as set forth in the U.S. Supreme Court's decision in New York Times v. Sullivan.
To sum it up for the tribe's elected officials and their attorneys, who like to pretend that U.S. Supreme Court decisions don't apply on tribal land, actual malice has to be proven and that the remarks or statements, or in this case a photo published, were known to be untrue, in other words, "reckless disregard for the truth."
I don't see this photo as a slam on Michell Hicks so much as I do a segment of his supporters who are both, non Indian, and scared as hell that average tribal members might gain power and influence. Once again, it's free speech. And it pales in comparison to the garbage that's come from the Hicks camp regarding Patrick Lambert and others who've dared to challenge his authority.

Of course it happened again. Facebook recently deleted a photo of a Klansman urging people to re elect Michell Hicks.
How did the primary turnout?
